Terms of Use

1. The Parties

NotairIA Inc., a company legally incorporated in Quebec, operator of the platform accessible at notairia.ca (hereinafter "NotairIA", "we"), and you, the registered user (hereinafter "the User").

2. Description of the Service

NotairIA is a SaaS professional assistance platform designed for Quebec notaries. It offers, among other things:

• The automation of Quebec Land Registry searches via a software agent
• The analysis and extraction of notarial document content by artificial intelligence
• A conversational assistant specialized in Quebec notarial law
• The management and organization of notarial files

3. Important Notice — Professional Assistance Tool

NotairIA is a technological assistance tool, not a legal advisory service. The analyses, summaries and responses generated do not constitute legal advice or a substitute for the notary's professional judgment. The User remains at all times responsible for verifying and ensuring the compliance of their work with the laws, regulations and ethical standards of the Chambre des notaires du Québec.

4. Access and User Account

4.1 Eligibility

Access is reserved for practising notaries in Quebec, jurists and authorized personnel of notarial offices.

4.2 Account Responsibility

You are responsible for the confidentiality of your credentials and all activities carried out from your account. Report any unauthorized access to info@notairia.ca.

4.3 One Account per User

Each account is personal and non-transferable. Multi-user plans are available for notarial offices.

5. Quebec Land Registry Credentials

By configuring your credentials, you:

• Authorize NotairIA to perform searches on your behalf via your personal Registry access
• Confirm that you are authorized to use these credentials in accordance with the Land Registry (MRNF) terms
• Assume responsibility for all searches performed, including applicable government fees

Your credentials are AES-256 encrypted, never transmitted to third parties, and used exclusively for searches you initiate.

6. Subscription, Credits and Payment

6.1 Credits

Using AI features consumes credits. Free credits are offered at registration.

6.2 Renewal

Subscriptions renew automatically until cancelled. Prices in Canadian dollars (CAD), subject to applicable taxes.

6.3 Cancellation and Refund

Cancellation at any time from Settings > Subscription, effective at the end of the billing period. No pro-rata refund. Separately purchased credits are non-refundable.

6.4 Price Changes

30-day notice. Changes do not apply to current periods.

7. Your Content

You retain full ownership of your files and documents. You grant NotairIA Inc. a limited, non-exclusive and revocable licence, strictly necessary for the provision of the service. Your content is never used to train artificial intelligence models.

8. Acceptable Use

You are prohibited from using NotairIA to:

• Perform Registry searches for purposes other than legitimate notarial professional use
• Bypass the security measures of the platform or the Land Registry
• Resell, redistribute or sub-license access
• Submit illegal content or content infringing third-party rights
• Use the platform for scraping or large-scale automated collection

9. Intellectual Property

The NotairIA platform, including its code, interface, algorithms and brand, is the exclusive property of NotairIA Inc. Any unauthorized reproduction or distribution is prohibited.

10. Limitation of Liability

NotairIA is provided "as is". NotairIA Inc. cannot be held liable for errors in Registry search results or decisions made based on the information provided. Our total liability is limited to amounts paid in the 12 months preceding the claim. We are not responsible for interruptions of the Quebec Land Registry, which is exclusively under the Quebec government's jurisdiction.

11. Termination and Suspension

You may cancel your account at any time from Settings > Account. NotairIA Inc. reserves the right to suspend or terminate your access in the event of a violation of these terms.

12. Governing Law and Jurisdiction

These terms are governed by the laws of the province of Quebec and the federal laws of Canada. Any dispute falls under the exclusive jurisdiction of the courts of Quebec.

13. Modifications

In the event of a substantial change, you will be notified by email at least 30 days before it takes effect. The current version is always accessible at notairia.ca/conditions/.
